Introduction

These GTCS govern the purchase, by computerised means, of all products presented on the website Spareparts Solema (spareparts-solema.it), operated by Solema Srl, based in Via Giosuè Carducci 18, 24066 - Pedrengo (BG), Italy.

It should be noted that these GTCS referring to Consumers, will apply exclusively to those who are included into this category. More precisely, Consumers will benefit from all the protections provided for Contracts concluded at a distance, according by Title III, Section II of D. lgs. September 6, 206 (Consumer Code) and any other applicable provision of law.

The following definitions apply within these GTCS:

"Consumer": any natural person who places an Order for purposes other than business, commercial, craft or Professional activity.

"Professional": any natural or legal person who places an Order in the exercise of his business, commercial, craft or Professional activity.

"Customer": may be either a Consumer or a Professional.

"Order": every proposal concerning the purchase of one or more products, formulated via Web by the Customer towards Solema Srl.

"Contract": every agreement between Solema Srl and a Customer about the purchase by the latter of one or more products, concluded using the Website.

 

Conclusion of the Contract via internet

Any Contract relating to the purchase of products will be stipulated in Italian and/or English. Unless otherwise specified, the products presented on this Website are intended only for users accessing this site from the national territory. Those who choose to access this site from other countries are responsible for compliance with local laws and their applicability.

The presentation of products on the site constitutes an invitation to Customers to formulate a purchase proposal to Solema Srl. Such invitations to offer do not represent offers to the public pursuant to art. 1336 of the Italian Civil Code, therefore Solema Srl reserves all decisions regarding the acceptance of the proposals that will be formulated.

By transmitting an Order via web, it will be handled as a purchase proposal. Solema Srl will have the faculty to accept or not the received Orders, without that, in case of lacked acceptance, the Customer can advance rights and/or claims. The Order will have to be considered accepted and consequently the Contract concluded in the moment in which the Customer will receive, to his own e-mail address, an Order Confirmation Email containing the acceptance of the same Order from Solema Srl. The Email of Order acceptance will be sent to the Customer only when Solema Srl will have verified the payment of the price by the Customer in the forms and by the means indicated in the present GTCS. No Contract will be considered concluded until Solema Srl will have issued such Order acceptance.

 

Data Protection

Solema Srl reserves the right to keep the data of each Order as well as the Customer's contact details for the sole purpose of using them for the correct execution of the Order, for any claims regarding the warranty of the item and/or for recommendations or instructions to the Customer regarding the item. The storage and processing of data will be in accordance with the content of the information regarding the protection and use of personal data by Solema Srl (Privacy Policy).

 

Content accuracy

Solema Srl has carefully prepared the content of this website, mainly to ensure that the prices shown are correct at the time of publication and that all products are accurately described. All the shown prices do not include VAT.

 

Availability

All products are subject to availability, in case of difficulties on the items ordered our Customer service will contact you within 48h working hours from the Order.

 

Mistakes in placing the Order

It is possible to make corrections or modify the Order up to the point where you give the OK clicking on the box "Place Order" on the final page of the Order process.

 

Prices

The prices of the products published on the Website are not inclusive of VAT and do not include any taxes, charges and duties applicable in the country of destination of the products, where this is different from Italy, which will be charged to the Customer.

All prices are indicated in EURO and do not include VAT at 22% and do not include transport costs. Transportation costs are indicated in the section "Shipping Methods". Solema Srl reserves the right to change prices at any time, stated that the price of the products purchased is the price indicated on the website at the time of Order placement.

 

Transport costs

The forms of transport are indicated during the check-out phase of the Order. You can select the method you consider most appropriate. The relative transport costs (excluding VAT) will be communicated within 24 hours after sending the request.

 

Payment

The Customer will pay the full price of the products ordered at the time of forwarding the Order confirmation. It is understood that in case of non-acceptance of the Order Solema Srl will promptly refund the Customers any amounts paid.

The accepted methods of payment are PAYPAL and BANK TRANSFER.

In case of payment arranged through bank transfer, Solema Srl will proceed to the shipment of the goods only after the verification of the happened effective credit on our bank account; we advise also the Customer that chooses this modality of payment to indicate the number of Purchase Order in the purpose of the bank transfer, in Order to avoid delays in the fulfilment of the Order.

Payments by credit card are accepted only through PayPal.

 

Delivery time

The delivery times from the time of shipment are the sole responsibility of the carrier that takes care of it and are generally estimated in 24/48h with express delivery, 3-5gg with standard delivery. When you select the mode "collection at our warehouse" the delivery is intended to be completed at the time of withdrawal.

 

Advices on the receipt of goods

The Customer is required to check the integrity of the package (including the closing tapes) and the contents of the package.

In case of non-conformity or apparent damage, the Customer must refuse the delivery and take contact, immediately and in any case within 7 days from the date of delivery, with the Customer service, reporting the incident.

 

Warranty and Claims handling

For purchases made by Consumers, the legal rules on warranty apply, include, where applicable, the rules provided by the Consumer Code regarding guarantees to the Consumer.

If defects in the purchased products under these GTCS will be found, the Consumer may contact Solema Srl in the manner indicated in these terms of sale and request repair or replacement of the product. The choice between repair or replacement will remain at the Consumer's disposal, except in the case in which the chosen remedy is objectively impossible or excessively expensive compared to the other.

Solema Srl will carry out the requested repairs and replacements within a reasonable period of time from the receipt of the Consumer's request. Solema Srl invites the Customer to describe in as much detailed as possible manner the nature of the defect or fault found and to indicate the Order number and any other useful data to the correct identification of the claim.

If the repair or replacement requested is impossible or excessively expensive or has not taken place within a reasonable time or has caused considerable inconvenience to the Consumer, the latter may request a fair price reduction or the termination of the Contract In any case, the termination of the Contract will not be allowed for minor defects, in respect of which it has not been possible or is excessively expensive to repair or replace the relevant products.

It is expressly understood that the provisions of this chapter will not apply in case of defects found in products purchased from Professionals, in respect of which, without prejudice to the mandatory limits of law, Solema Srl does not grant any warranty.

 

Right of Withdrawal

In accordance with the provisions of the Consumer Code, if the Customer is a Consumer, he will have the right to withdraw from the purchase Contract for any reason, without the need to provide explanations and without any penalty, except as indicated below. To exercise this right, the Customer must send to Solema Srl a communication to that effect, within 14 days from the date on which it acquires physical possession of the goods. Such communication will have to be sent by registered letter with acknowledgement of receipt to Solema Srl, Via Giosuè Carducci 18 - 24066 Pedrengo (BG), or by e-mail to our Customer Service: purchasing@solema.it. Within further 14 days from the date of sending of the communication of the will to withdraw, the Consumer will have to provide for the return of the goods to Solema Srl. The right of withdrawal is however subject to the following conditions:

  • the right applies to the purchased product in its entirety, not being possible to exercise withdrawal only on part of the purchased item;
  • the purchased goods must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessories); to limit damage to the original packaging, we recommend, when possible, to put it in a second box, it should be avoided in all cases the attachment of labels or tape directly on the original packaging of the product;
  • the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the Customer;
  • Solema Srl is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.
  • The right of withdrawal lapses totally, for lack of the essential condition of integrity of the good (packaging and / or its contents), in cases where Solema Srl ascertains: the lack of the outer packaging and / or the original inner packaging; the absence of integral elements of the product (instructions for use); damage to the product for reasons other than its transport.

 

Effects of the Right of Withdrawal

If the Consumer has exercised his right of withdrawal in accordance with the provisions set in these GTCS, Solema Srl will refund the Customer with the full amount already paid within 14 days from the return of the goods, by transfer of the amount charged. No damage may be requested to Solema Srl for any delays in the carrying out of goods replacements.

 

Modification of GTCS

Solema Srl will promptly publish on the Website any amendment to these GTCS.

The modified GTCS will become an integral part of the new Contracts following their publication on the Website.
